Writ seeks to revoke MP’s oath

Supreme Court of Bangladesh. BANGLATRIBUNE/Sazzad HossainA writ petition has been filed with the High Court seeking its directives to revoke the oath of the MPs of the 11th Parliament, citing they were sworn in illegally before the expiry of the 10th Parliament.
Supreme Court lawyer Advocate Taherul Islam Tawhid filed the writ on Monday (Jan 14) which might come up for hearing at the bench of Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal this week, said petitioner’s lawyer Barrister Mahbub Uddin Khokon.
The Speaker, Chief Election Commissioner and Cabinet Secretary have been made respondents to the writ which sought court’s directives to issue gazette after
Khokon, also secretary of Supreme Court Bar Association, said the writ petition was filed as a legal notice issued on Jan 8 in this regard went unheeded.
As per the writ, the Speaker administered oath to the new MPs on Jan 3 following the publication of a gazette which is the violation of section 123(3) of the constitution as they were sworn in before the expiry of the 10th parliament.
The five-year tenure of the 10th parliament was supposed to end on Jan 28.
