A legal notice challenging the legality of the new Cabinet taking oath without dissolving the 10th Parliament has been served to the Speaker, chief election commissioner and cabinet secretary.
Supreme Court Bar Association Secretary Barrister AM Mahbub Uddin Khokon served the notice on behalf of SC lawyer Taherul Islam Towheedur on Tuesday (Jan 8).
Khokon told Bangla Tribune that the new Cabinet sworn being sworn in without dissolving the previous Parliament violates Article 123 (3) of the constitution.
According to him, there are now two existing Parliaments which goes against constitution.
A 47-member Cabinet was sworn in on Monday (Jan 7) where the President administered oaths.
