The Apex Court will hear the state’s plea challenging stay order on proceedings in the case against photographer Shahidul Alam on Apr 11.
Appellate Division’s Chamber Judge Justice Hasan Foez Siddique passed the order on Monday (Mar 25).
Attorney General Mahbubey Alam moved the petition on behalf of the state while Barrister Jyotirmoy Barua represented Shahidul Alam.
Investigation of the case, filed under Section 57 of ICT Act, for which Shahidul was jailed, was stayed for three months by the High Court on Mar 14.
The court also issued a rule asking the government to explain why the continuation of probe in the case should not be declared illegal and contradictory to the Digital Security Act-2018 and the Constitution itself.
Shahidul Alam was arrested in a case filed under Section 57 ICT Act on Aug 5, 2018, few hours after he had given an interview to Qatar-based television channel Al Jazeera on the student protests for road safety.
Later on Nov 15, he was granted bail by the High Court.
