The High Court (HC) has scrapped a plea seeking the cancellation of actor and Awami League pick Akbar Hossain Pathan Farooque’s candidacy.
The HC bench of justices JBM Hassan and Kahirul Alam gave the orders on Wednesday (Dec 26) after the petitioners themselves pleaded for the writ to be scrapped on grounds of not being produced in court.
Previously, Bangladesh Jatiya Party (BJP) chief Barrister Andaleeve Rahman Partho filed a plea seeking to scrap the nomination of his opponent, Farooque on grounds that the actor was a loan defaulter.
Barrister Ahsanul Karim moved for the writ along with Partho, said that this move still leaves the window open for filing a writ against Farooque after the Dec 30 polls.
“The court told us that it’s still possible to challenge the validity of a nomination for loan default even after the election. Hence we moved to have the plea scrapped,” said Karim.
Meanwhile Partho’s other counsel, Ruhul Kuddus Kajal said that prior to filing his nomination, Farooque had voluntarily filed a writ with the HC saying that he owes money to the state-owned Sonali Bank but there has been no hearing on the matter.
Farooque and Partho are both running for Dhaka-17 on an AL and BNP ticket respectively.
