The Election Commission described stay order as ‘unfortunate’ as it had taken clearance from the local government ministry before holding the Gazipur ballot. The Election Commission (EC) will challenge the High Court order staying the Gazipur City Corporation.
EC Secretary Helal Uddin Ahmed told the media on Monday, two days after the court’s order, that they have decided to file an appeal against the order.
A legal consultant has been appointed and the commissioners are scheduled for a meeting with him this afternoon, he said.
“We had taken all preparations for this election. The schedule was announced following several communications with the local government ministry. But it’s unfortunate that it has been stayed,” Ahme said.
On Sunday, the High Court stayed the election, which was slated for May 15, for three months following a petition against redistricting of the city corporation.
Savar unit Awami League leader ABM Azharul Islam Suruj challenged the Election Commission’s gazette notification including six localities of Shimulia Union to the Gazipur City Corporation.
Suruj was elected as the chairman of Shimulia in the 2016 UP polls.
The court also issued a rule asking why the gazette notification and the schedules for the polls will be not declared illegal.
The BNP alleges of the government’s role behind stalling the polls, an allegation the ruling Awami League denies.
BNP candidate Hasan Uddin Sarker challenged the High Court’s stay order at the Appellate Division on Monday.
Awami League’s mayoral pick Jahangir Alam said he would also move to the top court against the order.
