Subarnachar rape: How the defence misled court

On Monday (Mar 18), the High Court granted bail for a year to suspect Ruhul Amin and on Thursday (Mar 21), an appeal was filed against the order.The trial court had denied bail to Ruhul Amin, the prime suspect in the rape of a woman at Noakhali’s Subarnachar on the night of Dec 30 last year.

Later, his counsel Ashek-e-Rasul moved the High Court (HC), which following a hearing granted bail. Following the order, state counsels accused the defence of suppressing important facts of the case and misleading the court. They have also termed the bail as ‘unprecedented’.

“The bail petition did not include confessional statements of the victim and other suspects and thereby, the counsel misled the court to get bail for his client,” Attorney General Mahbubey Alam said on Saturday (Mar 23), when the court revoked the order.

The petition was originally filed with the bench of justices M Enayetur Rahim and Md Mostafizur Rahman, but the defence then moved the bench of justices Mamnoon Rahman and SM Kuddus Zaman for a hearing, he said before adding, “It was clearly done to mislead the court.”

On Mar 18, the court granted one-year bail for Ruhul Amin and two days later, on Mar 21, the State moved the Supreme Court’s chamber judge against it.

Deputy Attorney General Biswajit Roy said then they challenged the order “as soon as the copy of the HC’s order was available”.

After the court revoked its order on Saturday, Attorney General Alam said they will seek a contempt rule against defence lawyer Ashek-e-Rasul. “The chief justice will also be informed on the matter.”

Case documents show that suspects confessed to commit the crime at the behest of prime suspect Ruhul Amin, which his counsel did not mention in the bail plea filed with the High Court.

Ruhul Amin was the publicity affairs secretary of Subarnachar Awami League, but the party expelled him after his alleged involvement in the rape case. He was also a former member of Char Jubilee Union Parishad.

On the night of Dec 30, the woman was gang-raped in Subarnachar by a dozen local AL activists for allegedly voting for paddy sheaf, according to the victim’s family.

On Dec 31, the victim’s husband started a case against nine people.
