The bench of Justice M Enayetur Rahim and Justice MdMostafizur Rahman set the date after concluding hearing on the appeal on Wednesday (Oct 16).
Advocate Abdul BasetMazumderand Advocate Rana Kowsarrepresented the suspended police inspector while Deputy Attorney General MdSarwar Hossain Bappi stood for the state.
Meanwhile, the State argued that the trial court has already heard eight witnesses and has scheduled the investigating officer’s deposition for Oct 30.
On Apr 15, Advocate Syed SayedulHaqSumon filed the Digital Security Act case accusing Moazzem for recording the statement of sexual assault of victim Feni madrasa student Nusrat Jahan Rafi without her consent and circulating the video on social media.
The court instructed the Police Bureau of Investigation (PBI) to probe the case and submit a report by Apr 30.
According to case details, Nusrat went to Sonagazi police station on Mar 27 to file a case against her madrasa’sprincipal Sirajuddaula for sexually assaulting her the day before.
Moazzem recorded a video of the victim’s statement without her consent while asking her offensive and insulting questions. The video then emerged on the social media, including Facebook and YouTube. The case accuses Moazzemof spreading the video.
Moazzem, whose voice was heard in the video, had also appeared unconcerned to Nusrat’s complaints and said the sexual assault incident was “nothing major”. He also asked Nusrat to go home and assured her of taking steps in accordance with her written complaint.
But no action was taken against Sirajuddaula. Her family members, however, returned to the police station later that day and filed a case.
On Apr 10, the OC was withdrawn as Nusrat family's alleged that they were not getting proper cooperation from him.
Nusrat, a student of SonagaziIslamiaFazil Madrasa, was set ablaze on Apr 6 allegedly for refusing to withdraw sexual abuse charges against principal SirajUd Doula.
After battling critical burn injuries for five days, the 18-year-old died at Dhaka Medical College Hospital on Apr 10.
