The High Court (HC) has curbed the judicial power of a Narail judge for one year for acquitting the prime suspect of a murder case.
The court has ordered the Ministry of Law, Justice and Parliamentary Affairs not to give criminal cases to Narail District and Sessions Judge Sheikh Abdul Ahad for the next one year.
It also asked the ministry to consult with the Supreme Court and take necessary actions against the Judge Ahad, who has recently apologized for exempting the main accused of Enamul murder case.
The HC bench of justices M Enayetur Rahim and Md Mostafizur Rahman passed the order on Thursday.
Enamul Haque was shot dead in front of Chondinagar Government Primary School in Barnail Bazar area of Narail on Feb 10, 2015.
On the next day, Enamul’s brother Nazmul Huda filed the case with the Kalia police accusing 67 people with Mollik Majharul Islam was named as the prime suspect.
However on Jun 10 this year, Judge Ahad acquitted Mollik and framed rest of the accused.
Later, Huda filed a petition with the HC seeking the cancellation of Narail Judge's order.
On Jul 7, the HC ordered the judge to explain why his judicial powers should not be curtailed for exempting the main accused of such a sensational murder case.
On Jul 10, the Narail judge sent a written apology to the Supreme Court registrar general’s office.
“I offer unconditional apology for the mistake and I will remain careful so as not to repeat the same mistake in the future,” Judge Ahad said.
On Jul 30, the attorney general’s office placed the copy of Judge Ahad’s written apology before the same bench.
