Parents can lodge case against errant children

Representational imageIf a son or daughter does not ensure maintenance for parents, the father or mother or a nominated person can lodge a case in court. The social welfare ministry recently finalized the draft allowance and maintenance law for parents.
The guideline also states that any person can inform of any lapses on the part of children towards their parents by giving a written complaint to the maintenance and allowance committee.
The committee will settle the matter within 30 days and inform the court; if the aggrieved person is not satisfied with the settlement then an appeal can be made within 15 days.
Once the committee gets a complaint, it will first go and talk to the parents and children and, provide advice. Later, at the suggestion of the committee, parents can lodge a complaint at the judicial magistrate’s court.
Once the court gets the complaint, it will take the matter into consideration and order a settlement. To settle the matter, the court will give dates to both parties and hearing will be held at a specified place.
Within thirty days of getting the complaint, compromise can be done with or without condition. If any party feels aggrieved by the court verdict then an application for re-evaluation can be made.
The law states that court will only take into consideration complaints of crime once they are lodged by parents. The court can send the matter to UP chairman, member or city corporation councilor for settlement.
In such cases, both parties will be given the chance of a hearing. Once crime is proved, the penalty will be Tk 100,000 at the highest with three month’s imprisonment in case the fine is not paid.
