Top court upholds order barring convicts from polls

Supreme Court of Bangladesh. BANGLATRIBUNE/Sazzad HossainAppellate division has upheld the High Court order that any person sentenced to more than two years in prison will not be able to take part in election.
Therefore, a person will not be able to take part in election if High Court suspends sentence or the appeal is running.
But if appellate quashes or suspends the sentence, the person in question will be able to take part in election, said Additional Attorney General Murad Reza.
The order was given by an Appellate bench led by Justice Syed Mahmud Hossain on Wednesday (Nov 28) over appeals asking for suspension of sentence.

On Tuesday (Nov 27), the appeal for suspension of sentence and conviction was dismissed by the High Court.

Meanwhile, Appellate division gave a ‘no order’ on the suspension of sentence appeal by Dr AZM Zahid Hossain of the BNP supported Doctors Association of Bangladesh, DAB.

At the court, Dr Zahid was represented by barrister Rokonuddin Mahmud, Ahsanul Kabir and Khairul Alam Chowdhury while state was represented by Attorney General Mahbubey Alam and Additional Attorney General Murad Reza.

Barrister Khairul Alam, told Bangla Tribune, “The appeal for sentence suspension was dismissed and when we went against the order a full hearing date was fixed based on which a ‘no order’ was issued.”

All legal avenues to have sentence suspended are exhausted, he said and added, “Whether he will be able to take part in polls or not will be decided by the returning officer.”
