The High Court has dismissed a writ petition seeking a re-evaluation of the quota system in government jobs.
The bench of Justice Syed Muhammad Dastagir Husain and Justice Md Ataur Rahman issued the order after hearing the petition on Monday.
Advocate Eklas Uddin Bhuiyan stood for the petitioner while Deputy Attorney General Amit Talukder represented the state.
Eklas Uddin filed the petition on January 31 on behalf of three students.
The petition says the government introduced 30% quota for freedom fighters and 10% quota for victimized women in 1972 for the government, private and semi-government and nationalized institutions.
Later, the quota system was reformed and changed on various occasions.
Currently, there is 56% quota– 1% quota is for the disabled, 30% for children and grandchildren of freedom fighters, 10% for women, 10% for districts and 5% for those in the ethnic community.
In 2008, the Public Service Commission in collaboration with the World Bank conducted a survey on the quota system in civil service. The survey found the quota system was unconstitutional and unjust. It also said no quota should exist forever. The survey found the quota system was conflicting with articles 19, 28, 29 and 29(3) of the Constitution.
The cabinet secretary, the Prime Minister’s Office secretary, law secretary and parliament secretary were made defendants in the petition.
