The High Court cleared the way for newly appointed principal of Viqarunnisa Noon School and College (VNSC) Prof Fougia Rezwan to join her post.
The court withdrew its stay order on her joining to the post of principal and also issued a rule asking the government to explain in four weeks why the appointment of Prof Fougia should not be declared illegal.
The HC bench of justice M Enayetur Rahim and Md Khairul Alam passed the order on Tuesday (Sept 17) and issued the rule after hearing a writ petition filed by Supreme Court lawyer Eunus Ali Akond challenging the legality of the appointment of Prof Fougia.
The petition argues that the governing body of Viqarunnisa is the authority to appoint its principal whereas the government has authority to appoint the teachers.
But the government illegally appointed Fougia as principal of the institution on Sept 15, although it has no jurisdiction to do so.
In 2018, principal Nazneen Ferdous and two other teachers of the institution were removed over the suicide of Aritree Adhikari, a student of the school.
Later, the school’s governing body appointed its assistant professor Hasina Begum as the acting principal.
