SirajganjCourt has show-caused four lawyers for rowdy behavior and usage of indecorous language against the magistrate after failing to secure bail for their clients.
The incident happened on Tuesday, Jul 10, in Sirajganj at the senior judicial magistrate court-1.
The accused lawyers are Abdur Rouf Panna, SM Deen Amin, Toifiqur Rahman Joy and Saiful Islam.
On Jul 9, advocate Toufiqur Rahman Joy requested bail for seven convicted persons. Despite being public prosecutors, Abdur Rouf and SM Deen Amin took part in the hearing by lawyers of the criminals.
Since there was concrete evidence against five persons for being involved in non-bailable offences, the judge refused the bail plea and sent them to jail.
Later, lawyers asked the judge to take into consideration the fact that the criminals did not surrender, which the judge disregarded.
On 12 July, during court proceedings, advocates Toifiqur and Saiful Islam, along with some trainee lawyers addressed the magistrate and began hurling abuse.
At one point, Saiful Islam took a chair and attempted to attack the magistrate, the magistrate order stated.
The order accuses the lawyers of unruly behavior and contempt of court.
The show cause further underlines that, as state prosecutors, it was the duty of advocates Abdur Rouf Panna and SM Deen Amin to prevent the bail appeal.
Instead, they spoke on behalf of the criminals, which is a breach of their professional integrity, the show cause added.
Considering the unsavoury incident, the lawyers have been given three days to provide written response as to why legal action should not be taken against them.
Advocates, Abdur Rouf Panna and Toifiqur Rahman Joy told journalists: “the magistrate is compelled to give bail since the case file does not have medical certificates.”
General secretary of Sirajganj Lawyers’ Association, advocate Kaosar Ahmed Liton, said: “as the guardian of everyone, the district judge will resolve the matter.”
